Two California Democrats are taking issue with the Federal Trade Commission's ongoing antitrust investigation of Google.

Reps. Anna Eshoo and Zoe Lofgren, who both represent Silicon Valley, wrote (PDF) to FTC Chairman Jon Leibowitz on Monday, questioning reports the agency is preparing to take legal action against the search giant. The lawmakers are concerned the agency has overstepped its authority while pursuing action against Google for potentially abusing its dominance of the search industry. The pair specifically cite reports that the FTC is preparing to expand its use of Section 5 of the FTC Act to include antitrust matter.

"Such a massive expansion of FTC jurisdiction would be unwarranted, unwise, and likely have negative implications for our nation's economy," the letter states. "Expanding the FTC's Section 5 powers to include antitrust matters could lead to overbroad authority that amplifies uncertainty and stifles growth."

The lawmakers argue the impact would be felt most acutely among Web companies, where innovation is rapid, and urge the FTC to reconsider litigating under the new interpretation of Section 5. The pair also question the release of sensitive information amid the press reports, arguing they could compromise the investigation.

Google has reportedly been pressed by the Commission to either offer remedies to the issues raised, or potentially face a lawsuit.
